The Home Office has published the ‘Forced Marriage Unit statistics 2023’, on ‘cases reported to the Forced Marriage Unit through its public helpline and email inbox during calendar year 2023’. The Home Office notes: “In 2023, the Forced Marriage Unit (FMU) gave advice or support in 283 cases related to a possible forced marriage or possible female genital mutilation (FGM). This does not include 519 forced marriage enquiries the unit received, which required signposting to relevant advice without requiring continuous actions or support by the FMU. The 283 cases in 2023 represents a 16% decrease on the number of cases (302) received in 2022." However, they do warn "This is unlikely to be indicative of a decrease in the prevalence of forced marriage in the UK, for which the FMU’s statistics are not a good guide; the statistics relate only to those cases reported to the unit and so the 16% fall could be a result of many different factors, for example the increase in the level of the unit’s outreach activity emboldening professionals to handle forced marriage cases without the FMU’s assistance, new legislation raising the age of marriage to 18 in England and Wales and greater media publicity about forced marriage being illegal in the UK.”#FamilyLaw #ForcedMarriage #FGM

    The Children’s Act invalidates any marriage contracted between a child who is under the age of 18 and an adult.It also invalidates any marriage contracted between a child and another child. This means that these marriages are not legally recognised. It also makes it an offense for a parent, guardian or any adult to contract such a marriage, force a child to contract such a marriage or cause a child to contract such a marriage and the offense is punishable for a term not exceeding 20 years. However, even with the law expressly prohibiting child marriages a 2018 report conducted by the African Commission on Human and Peoples’ Right showed that 36% of children in the Gambia were married by the age of 18 and 7% were married by the age of 15.Yet, the number of convictions for parents or guardians enabling or forcing such a marriage are minimal. This is because the act is still normalized and not shunned in The Gambia and as a result such incidents are not reported to the police.It is encouraged however that these children are protected and that these incidents are reported to the police or to the Ministry of Justice so that the child can be rescued and the parents or adults enabling the marriage can be brought to justice.
